‘Kick, Mark and Win’ Competition Terms and Conditions
Information on how to enter the Promotion and how to win the prizes forms part of these Terms.
Participation in this Promotion is deemed acceptance of these Terms.
1. Definitions.
In these Terms, unless the context indicates a contrary intention:
AFL Game means the Round 2, 2025 AFL Toyota Premiership Season match between Western Bulldogs and Collingwood at the Melbourne Cricket Ground, Brunton Avenue, Richmond, Victoria 3002 on Friday 21 March 2025 at 7:40PM AEDT.
Eligible Entrants are set out in clause 3.
Marking Contest means the game of skill/challenge the Contestant is to play set out in clause 9.
Mission Foods means Gruma Oceania Pty Ltd (ABN 35 117 976 002), trading as Mission Foods.
Prize means the prizes available as set out in clause 10.
Promoter means Footscray Football Club Limited trading as Western Bulldogs (ABN 68 005 226 595) of 417 Barkly Street, Footscray, Victoria 3011.
Promotion means the Mission Foods & Western Bulldogs ‘Kick, Mark and Win’ Competition
Promotional Period has the meaning set out in clause 2.
2. Promotional Period
The Promotion commences on 10 March 2025 at 10am AEDT and ends at 12pm AEDT on 18 March 2025.
3. The Promotion
The Promotion is open to residents of Victoria, aged 16 years of age or older.
Entrants must be able to attend the AFL Game, which is not able to be rescheduled.
Employees of the Promoter and Mission Foods (and their immediate family members) and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or cousin.
All Eligible Entrants aged 17 or under:
1. must have approval and prior consent from their parent/guardian or adult representative before entering the Promotion; and
2. shall have any Prize won awarded to their nominated parent/guardian or adult representative upon presentation of photo identification and winner confirmation email and the parent/guardian or adult representative shall be deemed the Contestant for the purposes of these Terms.
By approving a minor’s participation, completing an entry form or by accepting any Prize won on the minor’s behalf, the nominated parent/guardian or adult representative accepts these Terms.
4. How to Enter
To enter this Promotion, Eligible Entrants must, during the Promotional Period:
1. go to the Promoter’s official social channels, or Mission Foods official social channels, and click on the Promotion link; and
2. follow the prompts and fully complete and submit the Tradeable Bits entry form.
Completing steps 1 and 2 above, during the Promotional Period, will result in an entry.
Each Eligible Entrant may only enter the Promotion once.
5. Draws and Contestant notification
At the end of the Promotional Period, the Promoter will conduct a random draw of all entries at 1pm AEDT on 18 March 2025 at the office of the Promoter, to determine one (1) Eligible Entrant as the winner of the Ticket Prize and to attend the AFL Game to participate in the Marking Contest as set out in clause 9 for a chance to win the Marking Contest Prizes (Contestant).
The first valid entry drawn will be deemed the Contestant. The Contestant will be contacted via phone and email on 18 March 2025.
The Contestant must respond to the Promoter and claim the Ticket Prize within 24 hours of notification.
The Contestant must attend the AFL Game and follow the Marking Contest rules and directions of the Promoter for a chance to win the Marking Contest Prizes.
If the Contestant cannot be contacted (ie attempts to contact the Contestant have met with failure) or does not claim the Ticket Prize or the Promoter does not receive any return communication within the 24 hours following its notification, the Contestant will no longer be entitled to the Ticket Prize or any element of the Marking Contest Prizes and the Promoter may undertake a re-draw of all remaining entries, at the Promoter’s address on the next business day. In such case, the first valid entry drawn in the re-draw will be entitled to the Ticket Prize for their chance to win the Marking Contest Prizes at the AFL Game (Replacement Contestant). The Replacement Contestant is then the Contestant for the purposes of these Terms and will be notified by phone and email following the re-draw.
6. Publication of Winner
The Contestant’s details will be published online at www.westernbulldogs.com.au from 19 March 2025 for a period of 28 days.
7. Proxy or replacement Contestant
Under no circumstances whatsoever may the Contestant elect a proxy or replacement Contestant to be permitted to take part in this Promotion and participate in the Marking Contest at the AFL Game in lieu of the Contestant.
8. The AFL Game
The Contestant will receive the Ticket Prize. Mission Foods is responsible for fulfillment of the Ticket Prize for the Promotion to be supplied to the Contestant.
The Contestant must attend the AFL Game to participate in the Marking Contest to try to win the Marking Contest Prizes. In the event the Contestant does not participate in the Marking Contest at the AFL Game they are not entitled to win any Marking Contest Prizes.
If the Contestant is unwilling or unable to participate in the Marking Contest at the AFL Game, then they will forfeit their selection and the Promoter will conduct a new draw to determine a new Contestant.
If the Contestant fails to attend the AFL Game to participate in the Marking Contest on the day, the Promoter may select a new participant from the crowd at the AFL Game to participate for the chance to win the Marking Contest Prizes (at the absolute discretion of the Promoter).
9. The Marking Contest
The Contestant must attend the AFL Game to participate in the Marking Contest (as set out below) for the chance to win the Marking Contest Prizes.
The Marking Contest will operate as follows:
1. At quarter time of the AFL Game the Contestant will need to participate on the field in a game of skill.
2. The Contestant will be placed in an end goal square selected by the Promoter.
3. Two (2) people will be designated as ‘kickers’ and they will be positioned approximately 25 meters from and directly in front of the end goal square to take approximately 10 kicks of Australian Rules Footballs each within 2-3 seconds alternating within a total time frame of about sixty (60) seconds. The Promoter has sole discretion at the time of the Marking Contest as to the conduct of the Marking Contest.
4. The Contestant will have the chance to mark up to approximately twenty (20) Australian Rules Footballs that are being kicked, subject to time. The Promoter will judge a correct mark at the time of the Marking Contest, at its sole discretion. Any further attempts after the time ends for the kicks will be disqualified from the tally of marks.
5. The Promoter has the sole discretion of determining and judging a successful mark in the Marking Contest at the time, there will be no further discussion, and all decisions are final.
Attendance at the AFL Game is subject to the event venue and ticket terms and conditions. The Promoter and event organizers hereby expressly reserve the right to eject the Contestant and their companion for any inappropriate behavior, including but not limited to intoxication, whilst participating in any element of the Marking Contest or attending the AFL Game.
All costs associated with travel to and from the AFL Game is the responsibility of the Contestant and their companion.
10. Prize details
The Contestant will receive two (2) general admission tickets to the AFL Game, valued at $50.00 AUD (Ticket Prize).
If the Contestant achieves a successful mark whilst participating in the Marking Contest, they will win $250.00 AUD per mark with a maximum of $5,000.00 AUD in total available to be won (Marking Contest Prizes).
If the Contestant participates in the Marking Contest (regardless of any successful marks taken during the Marking Contest) they will be awarded one (1) Mission Hamper valued at $50.00 AUD RRP.
The total Prize pool is valued up to $5,100.00 AUD.
11. Prize fulfillment and conditions:
If the Contestant, through any legal incapacity or otherwise, is unable to register for the transfer of any Prizes won in their own name, then the Contestant may assign any Prizes won to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the Contestant and the assignee. The Contestant must provide the Promoter with certified copies of all required documentation as required by the Promoter before any Prizes won are awarded. It is a condition of accepting any Prizes won that the Contestant may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
12. General terms
(a) The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, tampered with the entry or Marking Contest process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
(b) If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
(c) If for any reason the Contestant does not take or redeem any Prize won at or by the time stipulated by the Promoter within 120 days, then the Prize will be forfeited.
(d) Eligible Entrants and the Contestant consent to the Promoter and Mission Foods using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products hired, distributed, and/or supplied by the Promoter.
(e) If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant and/or Contestant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
(f) Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
(g) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
ii. any theft, unauthorised access or third-party interference;
iii. any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
iv. any variation in Prize value to that stated in these Terms;
v. if the AFL Game is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;
vi. any tax liability incurred by a Contestant or Eligible Entrant;
vii. use of and/or taking of any Prize; or
viii. the participation of a Contestant in the Marking Contest.
(h) As a condition of participating in the Marking Contest, and/or accepting any Prize won, the Contestant may be required to sign any legal documentation as and, in the form, required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
(i) Any Contestant is warned that there is a possibility of an accident-causing injury through their participation in the Marking Contest at the AFL Game. Any participation in any physical activity at the AFL Game is undertaken at the Contestant’s own risk.
(j) All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants. By entering this Promotion, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging.
(k) The Promoter’s decision relating to all aspects of this Promotion is final and no correspondence will be entered into.
(l) By entering this Promotion, you indicate you have read and agree to be bound by the Promoters Privacy Policy: https://www.westernbulldogs.com.au/privacy.
(m) Mission Foods will not be held liable for any decision, act, or omission made by the Promoter. Mission Foods will provide the Ticket Prize as per the Terms provided herein. Mission Foods will not be responsible for any cancellation or postponement of the event, nor for any damages or losses incurred by the Contestant for participating in this Promotion.
(n) This Promotion is in no way sponsored, endorsed, administered or associated with Facebook. By entering, entrants agree to hold harmless, defend and indemnify Facebook from and against any claims, demands, liability, damages or causes of action, losses or costs arising out of their participation in the Promotion.
